I know, its been a while since I’ve posted.  My addiction has been to facebook, but even there, I’ve posted very litle.

Since about August 7, 2009, I have been embroiled in a criminal trial that took over 4 months to complete.  Really.  4 days a week, from 9 to 4, I was in court.  There were 10 defendants and 8 attorneys involved.  The matter went to the jury about one week before Thanksgivving and finally came back three days ago.  The defendants were all charged with conspiracy to commit aggravated assualt.  4 of them were charged with aggravated assault with the intent to cause serious bodily injury to a person under circumstances manifesting extreme indifference to human life.  The case went to the jury on those charges as well as with  2 Lesser Included  Offenses (agg assault as a 3rd degree fellony, causing serious bodily injury, and assaul) against the 4 defendants who were charged with assault.  The jury came back with not guilties on all the conspiracy charges and all the aggraavated assault charges; they were hung on the simple assault charges.

Will the government seek to retry the LIO?  If so, that would mean at least 4 months of transcriptions of he entire trial, probably 2 more months of trial, lots more money and lots more time wasted on the question of whether the officers were justified in the simple assaults.  We’ll see.
